At a glance
- These terms apply when you use our website, book or attend a consultation, or have a procedure with one of our gastroenterologists. Read them with our Privacy Policy.
- Consultations are private. Fees are confirmed by our rooms when you book, and a Medicare rebate applies where you hold a current referral.
- We don’t charge cancellation or non-attendance fees for consultations with our doctors. Please give us as much notice as you can so the appointment can go to someone else.
- Any amount you pay us before a procedure is refunded in full (less any payment-processing fee) if the procedure doesn’t go ahead, for any reason, at any time before the procedure date.
- Nothing in these terms limits your rights under the Australian Consumer Law.
1. About these terms
These Terms and Conditions (“Terms”) govern your use of the Premier Gastroenterology website (premiergastro.com.au), our online forms and booking page, and the services provided by Premier Gastroenterology (ABN 43 185 516 430) (“the practice”, “we”, “us”, “our”). By booking a consultation, using our website or online services, or attending the practice, you agree to these Terms. They should be read together with our Privacy Policy at premiergastro.com.au/privacy.
2. Who we are
Premier Gastroenterology is a specialist gastroenterology practice at Suite 5.1, 32 Erin Street, Richmond VIC 3121. Our gastroenterologists consult in our rooms and by telehealth, and perform colonoscopy, gastroscopy and related endoscopic procedures at Epworth Richmond, Epworth Hawthorn and Epworth Freemasons.
When you consult or have a procedure with one of our gastroenterologists, you enter into a practitioner–patient relationship with that doctor, who is a registered medical practitioner responsible for the clinical care they provide. The hospital, your anaesthetist and the pathology laboratory are separate providers who are responsible for their own services and bill you separately unless we tell you otherwise.
We have adopted the Australian Charter of Healthcare Rights, which sets out what you can expect from your healthcare: access, safety, respect, partnership, information, privacy and the right to give feedback.
3. Referrals, eligibility and suitability
Our services are for people aged 18 and over who reside in Australia. Medicare rebates for specialist consultations require a current referral from your GP or another practitioner; if you attend without one, or your referral has expired, you may still be seen but no rebate will be payable and you will be responsible for the full fee. We will tell you this before your appointment where we can.
Whether a consultation, procedure or other treatment is appropriate is a clinical decision made by your gastroenterologist in your interests. We may decline to provide, or may withdraw, a service where your doctor considers it clinically unsuitable, where you have not provided information reasonably needed for safe care or the information provided is materially inaccurate, where you no longer wish to proceed, or where your conduct towards our staff or doctors is abusive or threatening. Where we do so we will explain why where appropriate, and any refund position is dealt with in Section 8.
4. Fees, Medicare and private health insurance
We are a private practice. Consultation fees are payable on the day of your appointment. Our rooms will confirm the fee with you when you book, and the Medicare rebate that applies where you hold a current referral. Where we can, we will lodge your Medicare claim for you on the day.
If a procedure is recommended and you proceed:
- With private health insurance, the procedure is billed to Medicare and your health fund. The hospital facility fee is covered by your fund subject to your policy and any excess. A specialist gap fee may apply; where it does, we will tell you the amount before you book, collect it in advance, and it is refundable as set out in Section 8. Your anaesthetist and the pathology laboratory bill separately.
- Self-funded, if you do not have private health insurance, you can pay for the procedure yourself. There is no single package price: the hospital, your gastroenterologist, your anaesthetist and the pathology laboratory each charge their own fee and bill you separately. We will quote our gastroenterologist’s fee to you in writing before you book and, where we can, give you an indication of the other providers’ fees; those providers are responsible for confirming their own charges with you. If your procedure meets Medicare’s clinical criteria, you may be able to claim a rebate on part of each fee afterwards; we will give you an itemised receipt for our fee for that purpose.
In every case you will receive a written Informed Financial Consent document setting out the fees payable to us, and you will be asked to accept it before your procedure is confirmed. If a fee we quoted turns out to be wrong, we will tell you before the procedure and you may withdraw with a full refund.
Where Medicare or health-fund benefits apply, you are responsible for ensuring the Medicare and insurance details you give us are current and correct, and for any difference in cost if a benefit is unavailable because they are not.
5. Booking, payment and communications
Consultations are booked by contacting our rooms. Procedures may be booked through our online booking page, where you choose a list and date; the booking is confirmed by our staff, who will go through costs and preparation with you. Online payments are processed by Stripe, on-line transfer or by phone; we do not store your card details.
By giving us your email address and mobile number you agree to receive service communications through those channels — appointment confirmations and reminders, registration forms, procedure booking confirmations, preparation instructions, financial consent documents, results and reports, recall reminders and account matters. These are needed to provide your care and you cannot opt out of them while using our services. We do not send marketing.
Telehealth consultations are conducted by video using Coviu; we will send you a link before the appointment. Consultations may be audio-recorded and transcribed using an AI-assisted documentation tool that your doctor reviews and signs off; you may decline at the start of the consultation without affecting your care. Our Privacy Policy explains how this works.
6. Your consultation and procedure
Your gastroenterologist will assess your history and any results and discuss the options with you, which may include a procedure, other investigations, treatment, or a recommendation to see your GP or another specialist. The consultation fee is for the consultation itself, not for a particular outcome. You remain free to have any recommended procedure performed by any qualified practitioner you choose.
If a procedure is arranged, we will send you preparation instructions (bowel preparation for a colonoscopy or combined procedure; fasting instructions for a gastroscopy), information about what to expect, and your Informed Financial Consent. Follow the preparation instructions in your booking confirmation — they are specific to you and take precedence over general information on our website. Consent to the procedure itself is obtained by your gastroenterologist separately.
After your procedure your gastroenterologist will review the findings and any histopathology, and — where follow-up is recommended — enrol you in our surveillance recall register so that we can remind you when your next procedure is due. There is no separate charge for recall. You may opt out at any time by contacting us; if you do, arranging follow-up becomes your and your GP’s responsibility. Patients with significant findings are managed by their gastroenterologist through ongoing appointments rather than the automated register.
Not a substitute for your GP.
Our care is focused on your gastroenterological condition. Please continue to see your GP for general medical care and for anything outside our scope.
Emergencies.
We are not an emergency service. If you have severe abdominal pain, significant bleeding, vomiting blood, fainting, chest pain or difficulty breathing, call 000 or go to your nearest emergency department — do not wait for an appointment with us.
7. Your responsibilities
You agree to give us accurate and complete information — on your registration form, at your consultation and before your procedure — and to tell us if anything changes, particularly your medications, new symptoms or a change in your health between booking and procedure. Clinical decisions and the safety of any procedure depend on it. You agree to follow your doctor’s instructions, including preparation, medication and post-procedure instructions, and to treat our staff and doctors with respect.
You agree not to misuse our website or online services, including by attempting to access parts you are not authorised to use, impersonating someone else, or interfering with their operation.
8. Cancellations and refunds
Consultations. There is no cancellation or non-attendance fee for doctor appointments. If you cannot attend, please tell us as early as you can so the appointment can be offered to another patient, and we will help you rebook. If we have to cancel — for example because your doctor is unavailable — we will offer you the next available appointment.
Procedures. Any amount you have paid us before a procedure — a specialist gap fee, or our gastroenterologist’s fee where you are self-funding — is refundable in full (less any payment-processing fee) if you cancel at any time before the procedure date, if we or the hospital cancel and you do not wish to rebook, or if your gastroenterologist decides on clinical grounds that the procedure should not go ahead. We do not charge a cancellation fee. Any fees the hospital or your anaesthetist may charge for a late cancellation are a matter between you and that provider; we will tell you what we know of their terms when you book. If you do not attend without contacting us, please get in touch — we will always try to work with you constructively.
Consumer guarantees. Where the Australian Consumer Law entitles you to a remedy — for example because a service was not provided with due care and skill — that remedy is available to you and is not limited by these Terms.
How refunds are paid. Refunds are returned through Stripe to the card you paid with or direct transfer, usually within 5 to 10 business days depending on your card issuer. We do not refund in cash or to a different card.
9. Website content and intellectual property
Information on our website and in our patient resources is general guidance only. We take reasonable care to keep it accurate, but it is not a substitute for advice from your gastroenterologist or GP about your own situation. The content of our website, forms and materials is owned by or licensed to Premier Gastroenterology and may not be reproduced or adapted without our written consent, other than for your personal, non-commercial use.
10. Liability
To the maximum extent permitted by law: we do not exclude any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded; where our liability can lawfully be limited, it is limited to re-supplying the service or refunding the fee you paid for it; and we are not liable for indirect or consequential loss. The hospital, your anaesthetist and the pathology laboratory are independent providers responsible for their own services, and each of our gastroenterologists holds their own professional indemnity insurance. Nothing in these Terms limits liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
11. General
We may update these Terms from time to time; the current version is always at premiergastro.com.au/terms and the effective date at the top shows when it last changed. Continued use of our services after a change constitutes acceptance. Neither party is liable for delay or failure caused by events beyond its reasonable control, such as natural disaster, pandemic, public-health order or failure of utilities or telecommunications. These Terms are governed by the laws of Victoria, and you submit to the non-exclusive jurisdiction of its courts.
12. Complaints and contact
If you have a question about these Terms or a concern about our service or a refund, please contact us first — we will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.
